About these terms
This website is operated by Noctys Technologies, Inc. (“Noctys”, “we”, “us”), a corporation incorporated under the laws of Canada. In these terms, “the site” means www.noctys.com and its pages, including the status dashboard.
Our services
The site describes our services. It doesn't offer or form a contract for them. Managed services, security operations, and consulting are provided only under a separate written agreement with each client, and that agreement governs the service, including any service levels. If that agreement conflicts with these terms, the agreement prevails.
Using the site
You may browse and use the site for lawful purposes. You agree not to:
- attempt to gain unauthorized access to the site, our servers, or any connected system;
- disrupt or overload the site, for example with denial-of-service attacks or excessive automated requests;
- probe, scan, or test the site's vulnerabilities except as allowed by our security policy;
- use the site to transmit malware, spam, or unlawful content;
- misrepresent your affiliation with Noctys or impersonate us.
We may limit or block access to anyone who breaks these rules.
Status information
The status dashboard shows Microsoft 365 service health as reported by Microsoft through its public interfaces. We relay it as a convenience. It may be delayed, incomplete, or inaccurate, and it doesn't measure or represent any service level we offer. Don't rely on it as the only source for decisions that matter. For our clients, the notices and reports we send directly are authoritative.
Intellectual property
The site's content, design, text, graphics, and code belong to Noctys or its licensors and are protected by copyright and other laws. You may view and print pages for your own reference. You may not otherwise copy, modify, or redistribute them without our written permission. The typefaces used on the site are licensed under the SIL Open Font License.
“Noctys” and the crescent mark are our trademarks. Microsoft, Microsoft 365, and related names are trademarks of Microsoft Corporation. We use them only to identify the services shown, and their use doesn't imply any affiliation or endorsement.
Links to other sites
The site may link to websites we don't control. We're not responsible for their content or practices, and a link isn't an endorsement.
Disclaimer
The site and everything on it are provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties, express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, or non-infringement. The content is general information, not professional advice for your situation.
Limitation of liability
To the fullest extent permitted by law, Noctys and its directors, officers, employees, and contractors won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profit, or business, arising from your use of the site or your inability to use it, even if we were told such damages were possible. Nothing in these terms limits liability that can't be limited by law.
Indemnity
If you misuse the site or break these terms, you agree to indemnify Noctys against the resulting claims, losses, and reasonable costs, including legal fees.
Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. You and we agree to submit to the exclusive jurisdiction of the courts of Alberta for any dispute arising from these terms or the site.
Changes
We may update these terms from time to time. The date at the top of the page shows when they last changed. If you keep using the site after a change, the updated terms apply to you.
General
If any part of these terms is found unenforceable, the rest stays in effect. If we don't enforce a provision, we haven't waived it. These terms, together with our privacy policy, are the entire agreement between you and us about your use of the site.
